These terms govern the use of the Boxly app by people who book classes at their gym. By using the app you accept them. Our privacy policy explains how we handle your data.
Boxly is a service by Tommaso Rosso ([email protected]). With the app, gym members book classes, see memberships, entries and attendance, upload their medical certificate and receive messages from their gym. Gyms use a panel to manage schedules, members and memberships.
Boxly is a tool: the relationship stays between you and the gym. The gym decides schedules, seats, booking and cancellation rules, memberships, prices, whether to require a membership fee and a medical certificate, and records payments. Boxly collects no money and is not a party to the contract between you and the gym: for classes, memberships, refunds and complaints, contact the gym. When you join a gym with an invite code or an approved request, the gym sees your name, email, phone and profile photo and can message you through the app.
Bookings, waitlists, cancellations and limits (such as cancellation windows or no-shows) follow the rules set by the gym and shown in the app. A booking does not guarantee the class takes place: the gym may cancel or move it, and we will notify you.
If your gym requires it, you can upload your medical certificate from the app. It is health data: you upload it only with your explicit consent, the gym's owner, admins and front desk can see it, and it counts for booking only after the gym verifies it. Uploading it in the app does not replace the gym's legal duties or your own: make sure the certificate is valid and of the required type.
You may not use Boxly to access other people's data, bypass the gym's rules, send offensive or unlawful content, overload or attack the service, or use it with automated programs. In case of violations we may suspend or close the account, notifying you unless urgent.
The app may send push notifications and emails about bookings, waitlists, expiries and messages from the gym. You manage them from the app or phone settings.
We do our best to keep Boxly running, but the service is provided "as is" and may have interruptions for maintenance or failures. To the extent permitted by law we are not liable for indirect damages or losses due to interruptions, to errors in data entered by the gym, or to the gym's decisions. Nothing in these terms limits liability for wilful misconduct or gross negligence, or your statutory rights as a consumer.
The app, the panel, the brand and Boxly's content remain Boxly's. We grant you a personal, non-exclusive, revocable licence to use the app under these terms. Your data remains yours.
You can delete your account at any time from your profile: upcoming bookings are cancelled and your personal data deleted as described in the privacy policy. We may shut Boxly down with at least 30 days' notice in the app or by email; you will be able to download your data before then.
We may update these terms. For important changes we notify you in the app at least 15 days in advance; by continuing to use Boxly after that date you accept them. The date at the top shows the latest version.
These terms are governed by Italian law. If you are a consumer resident in the European Union, disputes go to the courts of the place where you live; you may also use the European online dispute resolution platform (ec.europa.eu/consumers/odr).
